This is a new thread to track council votes on issues that were not approved unanimously.

Rezoning 03-LPA-07 (http://www.townofcary.org/agenda/councilmin03/cm121103i2.htm) (Activity Center at NW Maynard Road and Chapel Hill Road): Proposal by the Town of Cary to amend Cary’s long-range Land Use Plan for an area of approximately 126 acres around the intersection of NW Maynard Road and Chapel Hill Road. The area corresponds to the Neighborhood Activity Center designated at that location by the current Land Use Plan as well as the Land Development Ordinance. The proposed amendment includes a mix of uses including commercial, office, institutional, and medium and low density housing.

Measure passed 4-3
yea - McAlister, Smith, Robinson, Joyce
nay - Dorrel, Roseland, Robison

Based on the discussion, the "nay" votes were based on the proposal not including some of the items suggested by the public input (this general topic was debated in another thread awhile back). In particular, drive-through uses and the commercial building height were discussed both at P&Z and council (the "nay" votes at P&Z were based on the building height issue).

Nels Roseland made a motion to approve, but require council approval of drive-through uses. It died for lack of a second. Both Julie Robison and Marla Dorrel expressed concerns about the "generally 3-story" commercial building height limit, vs. the "generally 2-story" limit that was clearly favored by the public input.

Given the unprecedented effort made by the town to gather public input in this case, I would have liked to have seen at least these two items included in what was approved.

I will say this about the area...I dont know how to accomplish this though....so I will post it on the Ensight Site too.....but with all the clear cutting in an area that has been heavily wooded they really need to get some deer crossing signs up on Maynard in that area. My experience on Friday Night will not be the last, and I suspect its one of the last places people expect to really see deer.
