For those of you who care, Cary has instructed Wake County to table the ETJ request for the Southeast area. Read the letter below.
While we at StopCary.com are happy that the process is stopped for now, I will say that personally, I am concerned at how this decision was reached. CTC requested the ETJ consideration by formal council action in an open meeting. This request to table was made by Bill Coleman who told me in a phone conversation that he "polled" the councilors about the tabling decision. This to me is a violation of open meeting laws.
The proper way to have done this was a simple item on the consent agenda to table a previous council directive. I find it interesting that staff can chage a council directive without formal council action.
So what this action by Coleman does is allows for him to simply write another letter to remove the issue from the table and continue on where they left off
You see the reason he states for the tabling request was due to uncertainty about Carys "new annexation plan" (not to mention tabling moves the County Commissioners decision past the November Election and the fact that Cary can not come up with sound law supporting the purported Ten-Ten / West Lake Road annexation of 2002...in a letter they state "the annexation has received no legal challanges")
Even if this was not a move to "protect' the commissioners, the possibility that with a "new annexation plan" new information will in all likelyhood change the original ETJ request
The bottom line is Cary should withdraw its ETJ request and start the process over if it intends to continue to pursue it.
Otherwise, this is just another case of limiting notification to the affected people involved. In otherwords the same old sneaky Cary

Dear David:
We have been advised by your Planning staff that the Town of Cary ETJ request has again been delayed from consideration by Land Use Committee of the Wake County Planning Board. Further, we understand that several County Commissioners have expressed concerns about considering this ETJ request in advance of completion of the Town’s Annexation Program.
Thus, we respectfully request that the ETJ extension be tabled by the Land Use Committee until this new annexation program is resolved by Town Council. We anticipate that this program, presently being prepared by staff, will be considered by Council in the next 6 months. Subsequently, we will advise you when we are ready for the ETJ request to be considered by Wake County.
