    I tried to negotiate with the Town in a gentlemanly way, and it didnt get me anywhere, said Mr. Bowden. I decided that the only way that I was going to get any attention was to put up a sign. Now the Town is trying to violate my civil rights by telling me that I cant speak to power.

    Lower courts ruled in favor of the builders, and the N.C. Supreme Court split on the issue last year, leaving the town and its insurance company to pay more than $800,000.
    Attorney Bill Brian of K&L Gates has been a key litigator for plaintiffs in both the recently settled and recently opened lawsuit. But at least two factors distinguish the lawsuits from one another.
    While the Amward suit was about a zoning condition, the new case involves a developer agreement, a contract signed by both the plaintiffs and the town. Secondly, there's the money.
    Cary never spent the money at the center of the first lawsuit. But the money now at issue was supposedly used years ago to build an elementary school. Panther Creek gave $500,000 to the town in 2001 and $5.5 million to the school board in 2007. Mills Park Elementary School opened in 2008.

    We are protecting our right to have a sign ordinance, wrote Mayor Harold Weinbrecht in an email this week.

    TRANSLATION: "We are protecting the right of Glen Lang, myself, and our successors to defectate on the First Amendment."

    "So far, the town has spent about $258,000 defending itself in the case, a sum it will pay win or lose. The towns insurance will cover some further costs, but will not pay the bill for a First Amendment specialist, which may continue to rise."

    Oddly enough, the guy suing Cary, Brent Reck, was the guy that signed the citation against the screwed house owner noted above. Now he is claiming Ricky Barker did all sorts of bad things. Barker is the guy who Susan Moran ordered to hide/not reveal the existance of certain public records in the face of a public records request from Ron Thoreson in an annexation related matter some years ago. Let's just clear the deck and state that these folks are not strangers to unethical behavior.


    They're so busy salivating at the prospect of bullying others around they cannot help but act aggressively towards each other as well.

    So the city government put up a web site about the Bowden / sign lawsuit.

    Most of it is self-serving tripe until the bottom. But here is the objectionable part:

    "How much will the Town spend on this appeal? How much has the Town spent so far?

    The cost to pursue this appeal to the US Court of Appeals will be modest compared to the initial cost of responding to Mr. Bowden's request for a temporary restraining order and preliminary injunction, and to the lawsuit itself.

    As of December 20, 2011, the Town has paid $214,119.20 in legal costs to respond to the request for a temporary restraining order and preliminary injunction and to the lawsuit itself. Mr. Bowden's attorney's fees will only be paid if the Town loses all appeals."

    The City has and will loose all the way on this lawsuit. The City will loose all appeals. There is only downside potential for city taxpayers on this on.

    I am somewhat curious. How would being Glen Lang's protege "stoke" anyone's 'passion for ...transparent governing'???? That makes no sense given the facts about Glen Lang.

    So, in looking back at the history of what Glen Lang and his lackey's (read Harold Weinbrecht) have done to the city of Cary I come first to a lawsuit. It was a simple matter. Harold and Glen tried to use city taxpayer's funds to create propoganda in the run up to an election.

    The case was J. Nelson Dollar v. Town of Cary 2010CV10583 and it was decdied in the Superior Court of Wake County.

    The money quotes are here:

    "When the expenditure of public funds for such purposes has the potential to influence the outcome of an election, the expenditure is not proper."

    "[I]t is more likely than not that a Wake County jury would find that a primary purpose of this [Campaign] is to influence [the Town's] voters in favor of "slow growth" or "managed growth" candidates in the upcoming election."

    Nelson Dollar's original complaint made this statement:

    "The action of the Defendants engaging in a propoganda campaign to coincide with a municipal election violates Plaintiff's rights as a citizen, voter and a candidate for town office."

    Nelson was correct, Harold and Glen were using taxpayer monies for partisan political propoganda production and dissemination.

    Harold Weinbrecht an advocate for "transparent governance": The one who says that is dishonest; the one who believes it is a fool.

    If anyone doubts Harold's particular guilt in this matter, the council minutes read:

    "Mr Weinbrecht stated he proposed this idea to get the message to Cary citizens....."

    The Court was correct, Harold was caught attempting to use taxpayers monies for his own partisan efforts.

    Only Jess Ward voted against this awful proposal. Glen Lang, Julie Robison, the ever regrettable Marla Dorrel, Shoeboy Roseland, and Harold voted in favor of Harold's plan.

    This is the legacy of Glen Lang and Harold Weinbrecht people.

    Be happy people, that particular legal mistep only cost the taxpayers of the city of Cary $3,615. Other individual instances of Glen and Harold's abuse of power have rung bills up close to a million dollars each and here I am only referencing CLOSED cases, currently open cases are still ringing up the dollar signs folks.

    This isn't old news. This is Glen and Harold and Harold is the current Mayor. He had no respect for state law or the taxpayers in 2001 when the Superior Court smacked him down and he has not changed.

    Our former Thug-n-Chief, Clubber Lang bullied and threatened private property owners to do his bidding while Mayor. In this case, he cause the city to run afoul of state law. We are still paying the legal bills for his thuggish and criminal conduct while in office.

    Lang's conduct is not "old news", we the taxpayers are STILL being sued because of the actions of this boorish clown and his lackeys. The current Mayor has long been a devotee of the Clubber Lang vision of absolute government control over everything everybody is doing. He is still fighting to keep the illegal sign ordinance, the money he and Clubber illegally extorted from these builders, and other artifacts of Clubbers despicable tenure as Mayor.
